Trump Asks Top Court Approval for National Guard Troop Deployment in the State of Illinois

On the end of the week, the government filed an emergency request to the nation's highest court, asking for approval to deploy state guard personnel to Chicago and surrounding areas.

This move is part of a larger campaign to increase the internal deployment of the troops in multiple cities run by Democrats.

Court Fight Over Troop Deployment

In an emergency filing, the US Department of Justice asked the court to reverse a earlier court order that had stopped the deployment of a few hundred state guard personnel to the Chicago region.

The federal judge had expressed skepticism about the government's reasoning for activating the guard, doubting its explanation in given the situation on the ground.

A appellate court supported the lower court’s decision on Thursday, keeping the deployment on pause while the judicial dispute moves forward.

Administration's Claims

The solicitor general, acting for the White House, stated in the recent request that federal agents have repeatedly been “threatened and targeted” in downtown Chicago and the suburb of Broadview community.

This site is home to an Immigration and Customs Enforcement holding center.

The president has already sent state guard forces to the Windy City and Portland, Oregon, after prior deployments to Los Angeles, Memphis, and the nation's capital.

The White House has stated that armed forces involvement is required to control demonstrations and support border control.

Ideological Opposition

Opposition leaders have strongly opposed the decision, claiming that the president’s claims are greatly exaggerated and partisan in nature.

They charge the administration of exploiting his power to retaliate against critics.

Judges have also voiced skepticism about the government's portrayal of the situation.

City officials state that demonstrations over deportation policies have been mostly small and peaceful, contradicting the administration's characterization of “combat area” situations.

Legal Basis

At the core of the dispute is the president’s use of a federal statute authorizing the executive branch to take control of the military reserve only in instances of rebellion or when “incapable with the standard military to carry out the regulations of the nation”.

The White House insists that the personnel are necessary to defend US facilities and personnel from demonstrators.

In recent weeks, the government nationalized three hundred personnel of the Illinois military reserve and commanded more Texas national guard troops into the state.

As city officials criticized the move, the White House escalated his rhetoric, demanding the apprehension of Chicago’s mayor and the Illinois governor, the two Democratic officials, accusing them of failing to secure ICE personnel.

State authorities and municipal government together took legal action against the government to block the sending.

On the ninth of October, district Judge April Perry, a Biden appointee, issued a preliminary order preventing the directive.
